Balan Nair Thamodaran heads the Construction & Engineering Department. Balan also heads the firm’s Arbitration Department. He was admitted to the Malaysian Bar in 2005 and holds a Master’s Degree from Queen Mary University, London, specializing in International Arbitration & Construction Law. He is also a Member of the Chartered Institute of Arbitrators, U.K and the Society of Construction Law, Malaysia.

Balan’s principal area of practice is in arbitration, both domestic and international, with primary focus on disputes involving Construction & Engineering. He is also experienced in handling both institutional (ICC, SIAC, LCIA and AIAC) and ad hoc (UNCITRAL) type of arbitration, as well as handling construction adjudication under the Construction Industry Payment and Adjudication Act (CIPAA) 2012.

In addition, he has advised and acted as counsel in arbitration proceedings involving commercial disputes, palm oil related disputes (PORAM) and disputes in the area of Information Technology (IT).

Balan is also an experienced litigator in both civil and commercial litigation, having acted for various corporations and individuals, as lead solicitor and counsel, in maritime, non-motor insurance, and contractual disputes.

In 2015, Balan was appointed by international law firms based in the US, Switzerland and Australia to act as counsel to represent family members of passengers on board MH370 and MH17 in the proceedings in Malaysia against the airline and several other entities / institutions.
