Alliff Benjamin Suhaimi (Ben) is a partner in the firm’s Civil Litigation department.

He is regularly appointed to advise and represent individuals and companies in matters relating to land disputes, land acquisition, defamation as well as corporate and commercial litigation. He has also acted as counsel in a number of high profile public interest litigation.

Ben has several reported cases under his belt across various practice areas. His notable cases include the recent Court of Appeal decision in Perbadanan Pengurusan Trellises & Ors v Datuk Bandar Kuala Lumpur & Ors [2021] where he represented residents of Taman Tun Dr Ismail in an application for judicial review to quash a planning permission/development order granted by the Datuk Bandar of Kuala Lumpur for the development on a piece of land which would affect Taman Rimba Kiara. The decision brought about a significant impact on public administration and planning laws. He has also, in the past, successfully represented a Malaysian politician in a defamation suit where the Federal Court ruling for the same contributed to the development of the law of defamation in Malaysia.

Most recently, Ben was appointed to represent residents of Petaling Jaya, Selangor in a judicial review application filed by a developer against the decision of the Selangor Appeal Board.

Ben is also representing a concerned KL residents in challenging the decision of a local authority in approving and gazetting the KL Local Plan.

Previously, he has also acted for a developer in resolving a long- standing land dispute with an illegal temple controlled by 2 opposing temple societies.

Team Members

  • Successfully represented residents of Taman Tun Dr Ismail in an application for judicial review to quash a development order granted by the Datuk Bandar of Kuala Lumpur.
  • Successfully represented a politician in a defamation action brought by a water concessionaire. The case attracted wide public interest and became one of the landmark cases in defamation law.
  • Acting for a resident of Petaling Jaya in a judicial review filed by developer against the Selangor Appeal Board.
  • Acting for residents of Kuala Lumpur in challenging the approval and gazettement process of the Kuala Lumpur Local Plan by the Datuk Bandar and the Minister of Federal Territories.
  • Successfully procuring an amicable settlement with 2 temple societies in a long-standing dispute over a piece of land owned by his client, the developer and owner of the land.
  • Successfully represented a sub-contractor to obtain an injunction against the main contractor of a construction project to restrain the release of the sums guaranteed under a performance bond.
  • Represented the Malaysian Trade Union Congress and 13 others in an application for judicial review against the Minister of Energy, Water and Communications over the refusal to allow access to a concession agreement and audit report. The decision by the Federal Court became one of the landmark judgments for judicial review.
  • Successfully represented a property holding company in defending a claim brought by a mineral extraction company for the sum of RM10.8 million.
  • Successfully represented an individual against a claim brought by the Malaysian Highway Authority to recover the sum of RM3.5 million which was paid pursuant to a compulsory land acquisition.
  • Represented a sub-contractor in a dispute concerning unpaid sums for works done which amounted to over RM2.2 million.
  • Represented a sub-contractor to set aside an adjudication decision on the grounds of denial of natural justice and the adjudicator having acted in excess of his jurisdiction.
